High Court Disposes of Habeas Corpus Petition Following Release of AAP MLA Kuldeep Kumar

NEW DELHI, AUGUST 18: The Delhi High Court closed proceedings on a habeas corpus petition filed regarding the alleged abduction of Kondli MLA Kuldeep Kumar after the Delhi Police confirmed that the legislator had been released from preventive custody. A division bench comprising Justice Navin Chawla and Justice Ravinder Dudeja noted that the primary purpose of the urgent plea stood fulfilled following his release.

 

“We are of the opinion that the purpose of the present petition has been served after Kumar’s release,” the bench stated, adding that the family remains free to seek alternative legal remedies regarding other grievances.

 

Law enforcement authorities informed the court during afternoon proceedings that the legislator was taken into preventive detention early in the morning and subsequently released at 3:48 pm.

 

“The MLA was taken into preventive custody in the morning and was officially released at 3:48 pm,” the Delhi Police stated, responding to submissions made on behalf of the lawmaker’s family.

 

The legal proceedings were initiated after the AAP MLA’s family approached the court, stating that plainclothes personnel had taken him from his residence at dawn following his participation in local demonstrations. AAP national convenor Arvind Kejriwal and senior party leadership had questioned the central administration regarding his whereabouts prior to the police submission in court.

 

Legal representatives for the lawmaker questioned the manner of preventive custody and alleged property damage during the police action, while the court granted liberty to the petitioner to pursue those claims separately.
