Haryana Rolls Out Witness Protection Plan

Chandigarh, 21 February— The Haryana government has launched the ‘Haryana Witness Protection Scheme 2025′ to safeguard witnesses facing threats or intimidation during judicial proceedings.

The scheme aims to encourage testimonies without fear by offering measures such as relocation, identity change, and enhanced security.

Who Qualifies?

The scheme applies to witnesses in cases involving the death penalty, life imprisonment, or sentences of seven years or more. It also covers specific sections of the Bharatiya Nyaya Sanhita (BNS) and the Protection of Children from Sexual Offences (POCSO) Act, 2012.

Threat Categories

Witnesses will be classified into three categories based on threat perception:

Category A: Life-threatening danger to the witness, their family, or close associates.

Category B: Threats to safety, reputation, or property.

Category C: Moderate threats involving harassment or intimidation.

Security measures include preventing direct contact between witnesses and accused persons, monitoring communications, installing surveillance systems, and providing personal security.

Witnesses may receive temporary relocation, state-funded transportation to court, and financial aid for sustenance or relocation. In-camera trials, video depositions, and specially designed courtrooms with protective features will also be available.

Protection orders will be granted for a maximum of three months at a time, subject to renewal based on continued threats.

Witnesses can apply through the competent authority, supported by identification and relevant documents. Upon application, a threat analysis report must be submitted by the local DCP or SP within two working days. Interim protection may be granted in urgent cases, with final decisions made within five days of receiving the threat report.

All hearings will be held in-camera to maintain confidentiality.

A Witness Protection Cell, led by the district DCP or SP, will enforce protection measures, while the DGP will oversee implementation. Cases requiring identity changes or relocation will be handled by the administrative department.

The scheme ensures confidentiality, preventing the disclosure of a witness’ identity. If deemed necessary, witnesses may receive a new identity with government-approved documentation. Relocation within Haryana or to another part of India may also be arranged, funded by the witness protection fund or, if agreed upon, by the witness.
