CHANDIGARH, Sept 3 — The Punjab and Haryana High Court on Wednesday allowed the regular bail plea of AAP MLA Raman Arora in a case registered under the Prevention of Corruption Act, officials said. Arora, elected from the Jalandhar Central constituency, had alleged that he was falsely implicated in the matter.
“The prosecution is malicious and politically motivated as witnesses with personal grievances have been projected as victims beyond the allegations in the FIR,” the petitioner had claimed. Arora had been in custody since his arrest on May 23.
The detailed order by Justice Tribhuvan Dahiya granting bail was not immediately available, though the high court’s official website showed the status of the plea as “allowed.” Arora was represented by senior counsel R S Rai along with advocates P S Ahluwalia, G S Bedi, Pawandeep Singh and Rubina Virmani.
During the hearing, the bench was informed that Arora was served with generic and faulty grounds of arrest that were not specific to him, allegedly violating Article 22 of the Constitution and Section 47 of the Bhartiya Nagrik Suraksha Sanhita (BNSS). His counsel contended that his arrest was illegal for non-compliance with Section 35(3) of the BNSS, which mandates issuance of a written notice when arrest is not necessary for a cognizable offence. They also noted that a checklist required under Section 35(1)(b)(ii) was not forwarded to the concerned magistrate.
