Chandigarh, June 17: The District Consumer Disputes Redressal Commission has held Mukat Hospital guilty of medical negligence and directed it to pay ₹25 lakh as compensation to a woman for mental agony and harassment caused during her treatment.
The commission further ordered the hospital to pay ₹6.37 lakh towards the cost of her corrective surgery at a private hospital in Gurugram and ₹10,000 as litigation expenses.
The case was filed by Susheela, who had undergone a procedure for gall bladder stone treatment at the hospital in September 2021. During the surgery, a stent inserted into her pancreas reportedly broke, leaving a fragment lodged in the pancreatic duct. She was later referred to a hospital in Gurugram, where the broken part of the stent was surgically removed.
Susheela alleged negligence and unnecessary mental trauma, while Mukat Hospital refuted the charge, stating that informed consent was taken and risks were explained to the patient beforehand.
After reviewing the arguments and evidence, the commission ruled in favour of the complainant, holding the hospital responsible for medical negligence and the subsequent distress.
