Parents Get ₹15.63 Lakh Compensation for Son’s Death in 2020 Crash

Chandigarh, Nov 4: The Motor Accident Claims Tribunal (MACT), Chandigarh, has ordered compensation of ₹15.63 lakh to the parents of a 23-year-old man who died in a road accident in Rajasthan five years ago.

The petition, filed by Lata Devi and Bal Mukand of Solan district in Himachal Pradesh, sought justice for the death of their son, Neeraj Kumar, who was working as a co-driver in a canter transporting goods from Nagaur to Srinagar.

According to the petition, on July 4, 2020, at about 5.30 pm near Kotputli in Jaipur district, the canter collided with a truck after the latter allegedly applied sudden brakes. Neeraj sustained fatal head injuries and died on the spot.

An FIR under Sections 279 and 304-A of the IPC was registered at the Kotputli police station. The parents claimed the accident occurred due to the negligence of both drivers and sought ₹50 lakh compensation, saying they were dependent on Neeraj’s monthly income of ₹19,500.

The driver and owners denied negligence, alleging a false case had been filed to claim compensation.

After examining the evidence, the Tribunal held the respondents — the drivers, vehicle owners, and the insurance company — jointly and severally liable, and awarded ₹15,63,179 with 7.5% annual interest from the date of filing till realisation.
