Chandigarh, Dec 5: A local court has sentenced a Dadumajra Colony resident to two years of rigorous imprisonment for possessing a country-made pistol without a licence. The court said the prosecution had proved “beyond reasonable doubt” that Kuldeep Kumar was carrying the weapon when he was detained near the DMC dumping ground in January 2022.
According to the prosecution, ASI Shamsher Singh received a tip-off on January 18, 2022, that a man carrying an illegal firearm was moving towards DMC Park. “We immediately set up a naka and began checking people and vehicles passing through the area,” ASI Singh said in court.
Police said Kuldeep was intercepted during the checking and a country-made pistol was recovered from him. He could not produce any permit or licence, leading to the registration of an FIR at Maloya police station under the Arms Act.
During trial, the prosecution examined six witnesses, including the investigating officer. Kuldeep denied the allegations in his statement recorded under Section 313 CrPC, saying, “I have been falsely implicated. I was not arrested from any naka, and the recovery is planted.”
The court rejected his defence and convicted him under Section 25 of the Arms Act. While seeking leniency, Kuldeep told the court he was poor and the sole breadwinner of his family. The judge, however, declined to reduce the punishment and imposed a fine of ₹2,000 along with the two-year jail term.
