A division bench comprising Chief Justice Ashwani Kumar Mishra and Justice Rohit Kapoor declared that general Supreme Court guidelines regarding post-retirement government housing do not restrict local authorities from addressing specific security concerns.
The court affirmed that the Union Territory administration made a deliberate policy choice grounded in current threat assessments and intelligence reports.
Legal counsel representing the Chandigarh Administration presented official affidavits confirming that the family faces ongoing security risks from radical outfits.
Authorities highlighted factors including recent regional security incidents, hostile online activity, and the operational suitability of the Sector 5 premises.
The bench maintained that the administration properly re-evaluated the situation following an initial allotment cancellation, concluding that relocating the family would introduce significant security risks.
