Bench seeks official response on petition challenging Commission decision-making processes

NEW DELHI, OCT 5: The Supreme Court issued notices to the Election Commission of India and the Union Government regarding public interest litigation challenging institutional decision-making procedures, while declining to pass interim restraining orders based solely on media reports.

A three-judge Bench headed by Chief Justice Surya Kant, along with Justices Joymalya Bagchi and V Mohana, reviewed petitions raising concerns over operational guidelines and procedural consensus within the poll body.

The apex court maintained that all named authorities must present their detailed responses to ensure decisions are evaluated against established legal frameworks.

The Bench affirmed that authenticated records and a transparent response from the commission are necessary before the court assesses the administrative validity of the challenged decisions.

During the proceedings, petitioner counsel pressed for immediate directions regarding commission operations pending further hearing.

The top court maintained that ex-parte conclusions could not be drawn without examining official inputs, asserting that appropriate statutory remedies remain available once the commission files its response.

The matter will be reviewed further following the submission of formal replies from all respondents.
