Chandigarh, Apri 28: The District Consumer Disputes Redressal Commission in Chandigarh has ruled in favor of a local resident after his newly purchased tyres deteriorated within three months. The commission directed both the manufacturer and the dealer to refund the purchase price and pay additional compensation for the inconvenience caused to the consumer.
The complainant, J.M. Jain, stated that he bought two Goodyear India Limited tyres for his vehicle from a Sector 22-C dealer in October 2020. Despite a two-year warranty, the tyres reportedly failed by December, with the tubes bursting and internal wires becoming exposed. Mr. Jain affirmed that an initial inspection suggested a manufacturing defect, yet the company later rejected his claim, forcing him to purchase a separate set of tyres for Rs 7,300 to keep his car operational.
The manufacturing company maintained that the damage resulted from external factors and improper wheel alignment rather than a production flaw. Legal counsel for the firm argued that such issues fall outside the scope of warranty coverage. However, the commission noted that the company’s technical report only cited “probable causes,” indicating a lack of certainty regarding the actual source of the failure.
The commission declared that the firm failed to provide substantial documentary evidence to support its claims of external damage. Consequently, the court ordered the opposing parties to refund the original Rs 6,800 with 6 percent interest and pay Rs 5,000 to cover mental anguish and legal costs.
