SC Slams Police Over Lackluster Firecracker Ban Enforcement

New Delhi, 12 November 2024: The Supreme Court criticized the Delhi police for failing to effectively implement the firecracker ban in the national capital, describing their actions as a mere “eyewash” for only seizing raw materials instead of preventing the sale and manufacture of crackers.

A bench comprising Justices Abhay S Oka and Augustine George Masih directed the Delhi police commissioner to immediately notify all relevant stakeholders about the ban and take decisive action to halt the production and sale of firecrackers. “We direct the Delhi police commissioner to establish a special cell dedicated to the strict enforcement of the firecracker ban,” the bench ordered. “The commissioner is also instructed to submit a personal affidavit outlining the measures taken to implement the ban effectively.”

The justices expressed concern over the delayed response by the Delhi government, questioning why the firecracker ban was not enforced until October 14, despite an earlier order. The bench underscored the significance of protecting public health, stating, “The right to live in a pollution-free environment is a fundamental right under Article 21 of the Constitution. It is our view that no religion advocates activities that lead to pollution or harm public health.”

Furthermore, the Supreme Court instructed the Delhi government to decide on the implementation of a “perpetual” firecracker ban by November 25, after consulting with stakeholders. The directive aims to address the ongoing issue of air pollution caused by firecrackers, particularly during the festive season, and calls for a comprehensive approach to safeguard the health and well-being of residents.
